Terms of Service

Welcome to Elite Youth Tour. These Terms of Service (the “Terms”) form a binding agreement between you and Elite Youth Tour, an Illinois nonprofit corporation operating Elite Youth Tour (“EYT,” “we,” “us,” or “our”), and govern your use of the EYT website at eliteyouthtour.com, any related subdomains, our online registration systems, our events, programs, communications, and any other services we provide (collectively, the “Services”).
By accessing the Services, registering an athlete, registering yourself, attending an EYT event, or otherwise interacting with us, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Services.
1. About Elite Youth Tour
Elite Youth Tour is a 501(c)(3) nonprofit organization dedicated to growing the sport of youth bowling and developing the next generation of athletes through tournaments, scholarships, and educational programming. Our mission is to give youth bowlers a platform to compete, develop, and leave their mark on the sport.
2. Eligibility, Parents, and Minors
Most participants in EYT programs are minors. EYT events, registrations, memberships, and Services involving athletes under the age of 18 require the involvement and consent of a parent or legal guardian (a “Parent”).
2.1 Account Holders
To create an account on the Services, complete a registration, submit payment, or accept these Terms, you must be at least 18 years of age and legally able to form a binding contract. Athletes under 18 may not register themselves; a Parent must complete and submit registrations on the athlete’s behalf.
2.2 Parental Consent
By registering an athlete who is under 18, you represent that you are the athlete’s Parent and that you: (a) accept these Terms on the athlete’s behalf; (b) consent to the athlete’s participation in EYT programs and events; (c) authorize EYT to provide Services to the athlete consistent with these Terms; and (d) accept responsibility for the athlete’s conduct and any obligations these Terms create.
2.3 Athletes Under 13
EYT does not knowingly collect personal information from children under the age of 13 except through a Parent in connection with a registration or program. Any account, registration, or communication involving a child under 13 must be initiated and managed by a Parent. Our handling of personal information is described in our Privacy Policy.
3. Account Registration and Security
When you create an account or submit a registration, you agree to: (a) provide accurate, current, and complete information; (b) keep your information updated; (c) safeguard your password and login credentials; and (d) accept responsibility for all activity that occurs under your account.
You must notify us promptly at info@eliteyouthtour.com if you suspect any unauthorized use of your account. We are not liable for losses caused by unauthorized account access that results from your failure to maintain account security.
4. Tournament Registration, Memberships, and Programs
EYT offers tournaments, memberships, scholarship programs, camps, and other youth bowling programs (each, a “Program”). Specific Programs may have their own rules, eligibility criteria, schedules, formats, and policies (“Program Rules”). Program Rules are incorporated by reference into these Terms. If a Program Rule conflicts with these Terms, the Program Rule controls for that specific Program.
We reserve the right to: (a) modify, postpone, relocate, or cancel any Program; (b) close registration when capacity is reached; (c) reject or revoke any registration; and (d) update Program Rules at any time. We will make reasonable efforts to communicate material changes in advance.
5. Fees, Payments, and Refunds
5.1 Fees
Registration fees, membership fees, and any other charges (“Fees”) are listed on the Services at the time of purchase. All Fees are stated and payable in U.S. Dollars unless otherwise noted. You are responsible for any taxes, bank fees, or third-party transaction fees associated with your payment.
5.2 Payment Processing
Payments are processed by a third-party payment processor STRIPE. By providing payment information, you authorize EYT and our payment processor to charge the payment method you provide for the Fees and any applicable taxes. We do not store full payment card details on our servers.
5.3 Refunds and Cancellations
Unless otherwise stated in the applicable Program Rules, registration Fees are non-refundable. If EYT cancels an event in full, registered participants will receive either a refund or credit toward a future event, at EYT’s option, less any non-recoverable third-party fees (such as payment processing fees). Refund requests for documented medical or family emergencies may be considered on a case-by-case basis at EYT’s sole discretion. To request a refund or transfer, contact diandra@eliteyouthtour.com with the registration confirmation and a description of the circumstances.
5.4 Chargebacks
If you believe a charge is in error, contact us first at diandra@eliteyouthtour.com before initiating a chargeback. Initiating a chargeback without first contacting us may result in suspension of your account, forfeiture of registrations, and ineligibility for future Programs.
6. Code of Conduct
EYT is committed to a safe, respectful environment for athletes, families, coaches, officials, and staff. By participating in any Program or using the Services, athletes, Parents, coaches, and spectators agree to abide by the following standards (the “Code of Conduct”).
6.1 General Conduct
- Treat athletes, officials, staff, volunteers, fellow competitors, and venue personnel with respect at all times.
- Follow all rules of the host bowling center and any applicable governing body (such as USBC) in addition to EYT Program Rules.
- Refrain from harassment, bullying, hazing, intimidation, profanity, threats, discrimination, or violence of any kind.
- Refrain from cheating, sandbagging, or any conduct that compromises the integrity of competition.
- Comply with the directions of EYT staff, tournament directors, and bowling center management.
6.2 Substance and Safety Rules
- Athletes are prohibited from possessing or using alcohol, tobacco, vaping products, or unlawful substances at EYT events.
- Adults shall not provide alcohol, tobacco, vaping products, or unlawful substances to any athlete.
- Weapons of any kind are prohibited at EYT events except as carried by licensed security or law enforcement.
6.3 Enforcement
EYT may, in its sole discretion, warn, remove, suspend, disqualify, ban, or refuse future registrations from any participant or spectator who violates the Code of Conduct or these Terms. Severe or repeated violations may result in forfeiture of Fees, scores, awards, prizes, or scholarships, without refund.
7. Photo, Video, and Likeness Release
EYT events are public competitions. By registering for or attending an EYT event, you acknowledge that EYT, its staff, contractors, media partners, sponsors, and other attendees may capture photographs, video, audio, statistics, and other recordings (“Media”) that may include the athlete’s and your image, likeness, name, voice, and performance.
You grant EYT a perpetual, worldwide, royalty-free, sublicensable, and irrevocable right and license to use, reproduce, edit, distribute, display, and publish the Media in any medium, including on the Services, social media, marketing materials, sponsor communications, fundraising appeals, and press releases, for any lawful purpose related to EYT’s mission. You waive any right to inspect or approve the finished Media.
If you do not consent to EYT’s use of an athlete’s likeness in marketing Media, you must submit a written opt-out request to diandra@eliteyouthtour.com before the event. EYT will use reasonable efforts to honor opt-out requests in EYT-produced marketing Media but cannot control incidental capture in broad event coverage, third-party media, or content posted by other attendees.
8. Assumption of Risk and Release of Liability
Participation in bowling and related activities involves inherent risks, including but not limited to: muscle strains, joint injuries, slips and falls on lane approaches, repetitive motion injuries, contact with equipment, and travel-related risks. By registering for or attending an EYT Program, the athlete and Parent voluntarily assume all such risks, whether known or unknown.
To the fullest extent permitted by applicable law, the athlete and Parent release, waive, and discharge EYT, its directors, officers, employees, volunteers, contractors, sponsors, host venues, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, and causes of action arising out of or related to participation in any EYT Program, except for liability resulting from gross negligence or willful misconduct of the Released Parties, and except where such release is prohibited by law.
Some EYT Programs require execution of a separate, signed waiver as a condition of participation. Where such a waiver is signed, that waiver controls the topics it addresses.
9. Health, Medical Authorization, and Insurance
Parents are responsible for ensuring that the athlete is medically fit to participate in EYT Programs and for disclosing any medical conditions or medications relevant to the athlete’s safety on the registration form.
In the event of a medical emergency where a Parent or designated emergency contact cannot be reached, you authorize EYT staff to seek and consent to emergency medical treatment for the athlete from licensed medical providers. You agree to be financially responsible for all medical care provided to the athlete. EYT does not provide medical insurance for participants.
10. Intellectual Property
The Services and all content on them, including text, graphics, logos, the EYT name, the “Leave Your Mark” tagline, photographs, video, designs, software, and the selection and arrangement of all of the foregoing (the “EYT Content”), are owned by or licensed to EYT and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use in connection with your participation in EYT Programs. You may not: (a) copy, modify, distribute, sell, or lease any part of the Services or EYT Content; (b) reverse engineer or attempt to extract source code; (c) use EYT trademarks, logos, or branding without prior written permission; or (d) frame, scrape, or use automated tools to harvest content.
11. User Content
You may have the opportunity to submit content to the Services, including registration information, comments, messages, photos, videos, and feedback (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant EYT a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, edit, display, distribute, and create derivative works from the User Content in connection with the Services and EYT’s mission.
You represent that you have all rights necessary to submit your User Content and that the User Content does not infringe any third-party rights or violate any law. EYT may, at its sole discretion, refuse, edit, or remove any User Content.
12. Third-Party Services and Links
The Services may include links to, or integrations with, third-party websites, applications, and services (such as payment processors, registration platforms, email providers, host venues, governing bodies, and sponsors). EYT does not control these third parties and is not responsible for their content, terms, privacy practices, or services. Your use of third-party services is governed by their own terms and policies.
13. Communications and Marketing
By creating an account or registering for a Program, you consent to receive transactional communications from EYT relating to your account, registrations, and events (such as confirmations, schedule updates, and policy notices) by email and, where you have provided a mobile number, by SMS.
You may also opt in to receive marketing communications from EYT, including newsletters, event announcements, and sponsor offers. You can unsubscribe from marketing emails at any time using the unsubscribe link in any marketing email or by contacting info@eliteyouthtour.com. Standard message and data rates may apply to SMS communications. To stop SMS messages, reply STOP.
14. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EYT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL EYT OR THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF EYT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EYT’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO EYT IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, EYT’s liability will be limited to the maximum extent permitted by law.
16. Indemnification
You agree to defend, indemnify, and hold harmless EYT and the Released Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms or the Code of Conduct; (c) your User Content; (d) the athlete’s participation in any Program (where you are the Parent); or (e) your violation of any law or third-party right.
17. Suspension and Termination
We may suspend, restrict, or terminate your account, registration, or access to the Services at any time, with or without notice, if we believe in good faith that you have violated these Terms, the Code of Conduct, or applicable law, or if continued access poses a risk to other participants, EYT, or the integrity of our Programs. You may close your account at any time by contacting info@eliteyouthtour.com. Sections that by their nature should survive termination will survive, including provisions on photo and video release, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
18. Dispute Resolution
18.1 Informal Resolution
Before filing any formal claim, you agree to first contact EYT at diandra@eliteyouthtour.com and attempt in good faith to resolve the dispute informally for at least 30 days.
18.2 Binding Arbitration
If the dispute is not resolved informally, you and EYT agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual action in small-claims court. The arbitration will take place in Cook County, Illinois or another mutually agreed location, and judgment on the award may be entered in any court of competent jurisdiction. This arbitration agreement does not preclude either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.
18.3 Class Action Waiver
YOU AND EYT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Subject to the arbitration provisions above, any judicial action permitted under these Terms must be filed exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
20. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date above and, where the changes are material, provide additional notice such as an email or a prominent notice on the Services. Your continued use of the Services after the effective date of an update constitutes acceptance of the revised Terms.
21. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to be enforceable, and the remaining provisions will remain in full force and effect.
22. Entire Agreement
These Terms, together with our Privacy Policy and any applicable Program Rules and signed waivers, constitute the entire agreement between you and EYT regarding the Services and supersede any prior agreements between you and EYT relating to the same subject matter.
23. Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. EYT may assign these Terms in connection with a merger, acquisition, reorganization, or sale of substantially all of its assets.
24. Notices
We may provide notices to you by email to the address associated with your account, by posting on the Services, or by any other lawful means. You may provide notices to EYT at the contact information below.
